Somly Terms & Conditions

Effective date: 25 October 2026

These terms are the agreement between you and Somly for using the Somly app on iOS and Android, the Somly Plus subscription and the somly.app website. By installing or using Somly you agree to them. If you do not agree, do not use Somly.

Somly ("we", "us") makes and operates the app. Contact: privacy@somly.app.

The short version

Who can use Somly

You must be old enough to agree to these terms where you live, or have a parent or guardian agree for you. Somly's Kids & Family features exist for exactly that case: a parent or guardian sets up and links a child's account, stays responsible for it, and can unlink it at any time.

Your account

Somly works without an account. If you create one — with an email address, an emailed sign-in link, Apple or Google — you are responsible for what happens under it and for keeping your sign-in method secure. Tell us at privacy@somly.app if you believe someone else is using your account. You may delete your account at any time in Profile → Delete account; the Privacy Policy explains exactly what that removes.

Your licence to use Somly

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Somly on devices you own or control, for your own use, in line with these terms and the rules of the app store you got it from. You may not:

Somly Plus

Somly Plus is an auto-renewing subscription sold through the Apple App Store or Google Play. Prices and periods are shown in the app before you buy.

If you got Somly from the Apple App Store, Apple's Licensed Application End User License Agreement also applies where these terms are silent, and Apple may enforce these terms as a third-party beneficiary.

Alarms, timers and reminders — please read this

Somly is a convenience, not a safety system. Whether an alarm rings on time depends on your phone: it must be on and charged, Somly must be allowed to send notifications and play sound, the volume, silent switch, Focus, Do Not Disturb, battery-saving and background-activity settings must let it through, and the operating system must not have stopped it. We build for reliability and tell you when a setting will get in the way, but we cannot control your device or your network, and we do not promise that any alarm, timer or reminder will ring at a particular time or at all.

Do not rely on Somly alone for anything where being late or missing the moment would cause harm or serious loss — medication, medical care, travel, work shifts, exams, childcare, cooking that is left unattended, or anything similar. Keep a backup where it matters.

Sleep tracking and health

Somly's sleep features — session tracking, sound highlights, quality scores, estimated sleep stages, Smart Wake and insights — are estimates produced from the time you set, the sounds your phone hears and your own answers. They are not medical measurements, not a diagnosis and not medical advice. Somly is not a medical device. If you are worried about your sleep or your health, talk to a healthcare professional; do not change medical treatment because of anything Somly shows.

Kids & Family

A parent or guardian may link a child's account and, with Plus, set alarms, send reminders and — if sleep sharing is turned on — review the child's nights and recordings for 7 days. By using these features you confirm that you are that child's parent or guardian, or the child whose parent or guardian set the link up. Either side can unlink at any time, which ends the access at once. You are responsible for how you use what you see.

Your content

Night recordings, dream notes, reminders, nicknames and avatars, and anything else you put into Somly remain yours. You give us permission to store, copy and process that content only as needed to provide the features you use — for example to keep a night recording on your phone, to sync your sleep history when you have Plus, or to deliver a shared night to a linked parent. You are responsible for having the right to record what your phone hears during a tracked night, including other people in the room.

If you send us feedback, ideas or suggestions, you agree we may use them freely to improve Somly without owing you anything.

Third-party services

Somly relies on services we do not control: Apple and Google for sign-in, notifications, purchases and cloud infrastructure, MET Norway for weather forecasts, GeoNames and OpenStreetMap (through Photon) for place search, Cloudflare for our weather service, and Cloudflare and Pollinations for the background pictures you ask Somly to generate. Their terms govern your use of their services, and outages or changes on their side can affect Somly. We are not responsible for third-party services or for content they provide.

A generated background is made by a third-party image model from the words you type. It may not match what you asked for, and you are responsible for what you ask it to make. The number of pictures an account can generate in a day is limited.

Intellectual property

Somly — the app, its name and logo, its design, artwork, sounds, texts and source code — is © 2026 Somly. All rights reserved. It is protected by copyright and other intellectual-property laws. Nothing in these terms gives you any right to use the Somly name or logo. Apple, the App Store, Google and Google Play are trademarks of their respective owners.

Ending the agreement

You can stop using Somly at any time and delete your account in the app. We may suspend or end your access to Somly or to Plus if you break these terms, if we must for legal or security reasons, or if we stop offering Somly; in the last case we will give reasonable notice where we can. Your store's refund rules apply to any unused subscription period. Sections about your content, intellectual property, disclaimers, liability and governing law survive the end of the agreement.

Disclaimers

Somly is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including fitness for a particular purpose, accuracy of any estimate, or uninterrupted, error-free or timely operation. Some places do not allow some of these exclusions, so some may not apply to you.

Limitation of liability

To the fullest extent the law allows, Somly is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of or inability to use Somly — including a missed or late alarm, timer or reminder, or reliance on any sleep estimate. Our total liability for all claims relating to Somly is limited to the amount you paid us for Somly Plus in the twelve months before the claim, or, if you paid nothing, to CAD 50.

Nothing in these terms limits liability that cannot be limited by law, or the rights you have as a consumer under the laws of the country where you live.

Changes to these terms

We may update these terms as Somly changes. We will post the new version at https://somly.app/terms/ and move the effective date; for significant changes we will also tell you in the app. Using Somly after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Where the consumer-protection laws of your own country give you rights that cannot be waived, those rights are not affected, and you may bring a claim in your local courts.
